TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By downloading, installing, or using FitCheck ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. We reserve the right to modify these Terms at any time, and your continued use of the App constitutes acceptance of any changes.

2. DESCRIPTION OF SERVICE

FitCheck is a fitness application that provides:

• AI-powered body analysis using photos you provide
• Personalized workout plans based on your body type and goals
• Exercise demonstrations with video content
• Progress tracking and fitness insights

3. ELIGIBILITY

You must be at least 13 years old to use FitCheck. If you are under 18, you represent that you have obtained parental or guardian consent to use the App. By using FitCheck, you represent and warrant that you meet these eligibility requirements.

4. USER ACCOUNTS

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized access to your account
• You may not share your account with others or create multiple accounts
• We reserve the right to suspend or terminate accounts that violate these Terms

5. SUBSCRIPTION AND PAYMENTS

Subscription Plans

FitCheck offers premium features through paid subscriptions. Current pricing is $3.99 per week, billed through the Apple App Store.

Billing

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

Cancellation

You can cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of your current billing period. No refunds are provided for partial subscription periods.

Restore Purchases

If you reinstall the App or switch devices, you can restore your subscription through the "Restore Purchases" option in the App settings.

6. USER CONTENT

By uploading photos or other content to FitCheck, you:

• Grant us a license to use this content to provide our services
• Represent that you have the right to share this content
• Agree not to upload content that is illegal, harmful, or violates others' rights
• Acknowledge that photos will be analyzed by AI systems

7. ACCEPTABLE USE

You agree NOT to:

• Use the App for any illegal purpose
• Upload inappropriate, offensive, or harmful content
• Attempt to reverse engineer or modify the App
• Interfere with the App's operation or security
• Use automated systems to access the App
• Impersonate others or misrepresent your identity
• Share your account access with third parties

8. HEALTH AND FITNESS DISCLAIMER

• Consult a physician before starting any exercise program
• Stop exercising immediately if you experience pain, dizziness, or discomfort
• AI body analysis provides estimates and may not be 100% accurate
• Workout recommendations are general guidelines, not medical prescriptions
• Results vary based on individual effort, genetics, and other factors

9. INTELLECTUAL PROPERTY

All content, features, and functionality of FitCheck are owned by us and protected by copyright, trademark, and other intellectual property laws. This includes:

• The FitCheck name, logo, and branding
• App design, graphics, and user interface
• Exercise videos, images, and descriptions
• AI algorithms and analysis methods
• Workout plans and fitness content

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• FitCheck is provided "as is" without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• We are not liable for any injuries resulting from exercises performed
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the subscription

11. INDEMNIFICATION

You agree to indemnify and hold harmless FitCheck and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

12. TERMINATION

We may terminate or suspend your access to FitCheck immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Conduct harmful to other users or the App
• Any reason at our sole discretion

Upon termination, your right to use the App will cease immediately.

13. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of competent jurisdiction.

14. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
